On the problem of registration of the enterprises with foreign investments in Uzbekistan

The article reviews the legal provisions in Uzbekistan regulating registration, re-registration and record archiving of enterprises established with some foreign investment capital. Two laws are reviewed in particular, namely those “On Property in the Republic of Uzbekistan” and “On Foreign Investments”, together with other relevant provisions. After highlighting some theoretical and practical issues, the author stresses the need for clarity in the definition of investment related terms. The bulk of the article is devoted to an analysis of specific aspects of the domestic legislation on the formation, registration, reregistration and record-archiving of enterprises with foreign investments. There is a detailed review of the inherent contradictions, gaps and anomalies, together with specific proposals for amendment. These proposals relate primarily to the clarification of criteria for defining the economic objectives of enterprises with foreign investments; for changing the category of registration, and the requirements for re-registration and archiving. Proposals are given for the elimination of some more general legal obstacles to the operations of enterprises with foreign investments in the national economy.
