On the problem of the implementation of the principle of fiduciary duty in the countries of the non-Anglo-American system of law

Abstract

The transplantation of legal norms and principles of one country in the legal system of another has now become quite commonplace. Legal transplants can be carried out in the form of the introduction of an entire system of law or a single EU norm. An example of transplantation can be the German corporate governance model adopted in Uzbekistan, or some fundamental institutions of Roman private law: Perhaps the main advantages of legal transplantation in the legislative activity of states are its speed, cheapness and efficiency.
